As of 2024, Massachusetts requires most towns to allow ADUs by right on any residential lot with a single-family home. This means Cape Cod towns can no longer broadly prohibit ADUs — making this the best time in Massachusetts history to build one.

Massachusetts passed significant ADU legislation that took effect in 2024 as part of the Affordable Homes Act. The law fundamentally changes what Cape Cod homeowners can build on their property — making now the most favorable regulatory environment for ADU construction in state history.

Towns can no longer broadly prohibit ADUs on lots with existing single-family homes. If your lot has a single-family residence, you have a legal path to build an ADU — even in towns that previously blocked them.
Up to 900 sq ft permitted as-of-right
Units up to 900 square feet must be permitted by towns without requiring special permits or variance hearings in most circumstances. This is the most common ADU size on Cape Cod.
